These Terms and Conditions ("Terms") govern your access to and use of the services provided by Spark Marketing (SMC-Private) Limited ("we," "us," or "our"). By accessing or using our services, including our marketing platforms, digital tools, and website, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using any part of the Spark Marketing platform — including but not limited to submitting a service request, using our digital marketing tools, registering as a client, or browsing our website — you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you may not use our services.
2. Definitions
Platform: The digital infrastructure, websites, and software operated by Spark Marketing for providing marketing and advertising services.
User: Any individual or entity using the Spark Marketing platform, including visitors and registered clients.
Client/Merchant: A business or individual that has registered with Spark Marketing to use our marketing, SEO, or social media management services.
Services: All services provided by Spark Marketing, including but not limited to Social Media Management, Content Marketing, SEO, and Brand Strategy.
3. User Responsibilities
Users must provide accurate, current, and complete information during registration and project onboarding.
Users must not use Spark Marketing services for any unlawful, fraudulent, or abusive purposes, including the promotion of prohibited or illegal content.
Clients must adhere to all applicable local laws and specific platform guidelines (e.g., Meta, Google, TikTok) when using our services.
4. Company Responsibilities
Spark Marketing shall make reasonable efforts to maintain the uptime of its digital platforms and the security of client data.
Spark Marketing will facilitate project milestones, campaign reporting, and communication according to the specific service agreement.
5. Limitation of Liability
To the fullest extent permitted by law, Spark Marketing is not liable for:
Third-party platform changes or outages (e.g., algorithm updates or ad account suspensions by social media networks).
Indirect, incidental, punitive, or consequential damages resulting from marketing campaigns.
The business performance or sales results of a client, as marketing ROI is subject to market variables.
Liability is limited to the service fee paid for the specific month in question or PKR 10,000 — whichever is lower.
6. Termination of Access
We reserve the right to suspend or terminate access to our services at any time, with or without notice, for any reason, including violation of these Terms or non-payment of agreed fees.
7. Force Majeure
Spark Marketing shall not be held responsible for any failure or delay in service due to causes beyond our control, including but not limited to acts of God, natural disasters, internet outages, cyberattacks, or governmental restrictions.
8. Cookies & Tracking Policy
Spark Marketing may use cookies and tracking technologies to improve your experience. By using our platform, you consent to:
Essential Cookies: Required for website functionality and security.
Performance Cookies: To help us understand website usage and optimize user experience.
Analytics Tools: Usage of tools such as Google Analytics to monitor traffic patterns and improve our digital outreach.
9. Service Usage Policy
Permitted Use: Our marketing strategies and content are provided for the client's specific business operations as outlined in their contract.
Prohibited Activities: Spark Marketing services must not be used for promoting hate speech, illegal products, or misleading financial schemes.
Intellectual Property: While clients own the final approved designs, Spark Marketing retains rights to the underlying strategies and templates unless otherwise agreed in writing.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Pakistan.
11. Amendments
We may amend these Terms from time to time. Users will be notified via website notice or email. Continued use of the service constitutes acceptance of the updated Terms.
